The LSA Board of Directors is extremely appreciative of the 283 Members who voted and expressed their opinion on our recent dues proposal. According to our highly restrictive Covenants & Restrictions recorded in 1966, the quorum requirement for any such action is 60% of all Members. If the required quorum is not met, the subsequent quorum requirement is ½, or 30%, for a vote held within 60 days following the original vote.
At the time of our dues proposal mailing, the LSA consisted of 493 Members. At that time 15 Members were not eligible to vote due to delinquency (on a side note, all 15 of these Members have had small claims collection proceedings instituted by Gerow), so 478 Members were eligible to vote. The 60% requirement to meet quorum was 287 Members casting votes. Gerow Management received 283 ballots, 2 of which were not signed and did not include a return address so the votes could not be validated. Therefore, Gerow received 281 valid votes, missing quorum by SIX (6). A failed quorum invalidates the November dues increase proposal vote.
The LSA will continue to proceed as outlined in our Covenant & Restrictions (above), and will call a second vote on the same proposal within sixty (60) days. The Board plans to allow for the holidays and send a mailing to the Membership on January 2, 2018, to be returned and postmarked to Gerow Management by February 1, 2018, and counted by Gerow on Friday, February 2, 2018. If successful, this will give approximately 60 days’ notice of a dues increase before dues are due and payable on April 1, 2018.
This second vote with require a 30% quorum. Using the same numbers, a quorum would require 144 Members to cast votes. In addition to the quorum restriction, our Covenants & Restrictions state we must have the assent (yes vote) of two-thirds (2/3) of all voting members.
The actual voting on the November proposal was even closer than meeting quorum. You can see how important EACH & EVERY vote is regarding this dues increase. 2 yes votes are required for every 1 no vote for this proposal to pass, and additional funds remain necessary for the Association to meet its necessary expenses.
PLEASE TAKE THE TIME TO CAREFULLY CONSIDER & FOLLOW THE INFORMATION & VOTING INSTRUCTIONS INCLUDED IN YOUR UPCOMING JANUARY BALLOT MAILING. It is imperative that everyone’s voice is heard.
